What followed would not only reshape federal authority—it would lead to devastating consequences for an entire nation.
In this episode of Lest We Forget Historical, Lillian Cauldwell reminds us that our current president is not the first to clash with the
Supreme Court — nor the first to back down. That distinction belongs to President Andrew Jackson during the 1832 case Worcester v. Georgia.
The case centered on a dispute between the Cherokee Nation and the state of Georgia. Treaties between the United States and the Cherokee
Nation guaranteed the tribe’s sovereignty on its Georgia lands. But once gold was discovered there, Georgia sought to remove the Cherokees
and assert full control over the territory.
The federal government attempted to persuade the Cherokees to move west, but most refused to abandon their homeland. Georgia responded by
passing laws that stripped the Cherokee government of its authority and even stationed guards over the gold mines. President Andrew
Jackson took no action to stop these violations of U.S.–Cherokee treaties. At the governor’s request, he went further and withdrew federal troops from the reservation.
The Cherokees challenged Georgia’s actions in court. Their attorney, William Wirt, warned the justices, “What is the value of that
government in which the decrees of its courts can be defied and mocked at with impunity? It is no government at all.”
Chief Justice John Marshall ultimately ruled that the Supreme Court lacked jurisdiction, leaving Georgia’s actions intact. Georgia
prevailed, removed the Cherokees from their land, and set in motion what became the Trail of Tears.
President Jackson ignored the Court’s position and allowed Georgia to proceed. Missionaries who supported the Cherokee cause were sentenced
to four years of hard labor, and the administration dismissed the Worcester decision to prevent it from limiting federal or state authority.
In the end, the Cherokees lost their homeland, and the nation witnessed one of the most consequential confrontations between a
president, a state government, and the Supreme Court.
This moment in history is not just a reflection of the past—it raises ongoing questions about power, responsibility, and whether the rule of law can withstand political pressure.
